End User License Agreement (EULA) & Terms of Use
1. Acknowledgement & Relationship with Apple
This Agreement is entered into between you and Conem Labs, not with Apple Inc. Conem Labs is solely responsible for the Application and its content. Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.
2. Scope of License
Conem Labs grants you a non-transferable, non-exclusive, revocable license to use SomaFocus on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. You may not decompile, reverse-engineer, modify, or create derivative works of the Application.
3. IMPORTANT HEALTH & MEDICAL DISCLAIMER (NOT MEDICAL TREATMENT)
NOT A MEDICAL DEVICE OR CLINICAL TREATMENT
SOMAFOCUS IS AN ATTENTION-PACING, PRODUCTIVITY, AND ERGONOMIC SENSORY TOOL. IT DOES NOT CONSTITUTE A MEDICAL DEVICE, MEDICAL TREATMENT, CLINICAL DIAGNOSIS, OR THERAPY.
- No Clinical Claims: The guided breathing exercises (Freeze Breaker), physiological sighs, procedural audio tones, and haptic feedback provided by SomaFocus are intended solely as lifestyle and attention-regulation scaffolding.
- Seek Professional Care: SomaFocus is not a substitute for professional medical advice, psychiatric evaluation, diagnosis, or treatment of Attention Deficit Hyperactivity Disorder (ADHD), anxiety disorders, or any other physical or mental health condition. Always consult a qualified physician or healthcare provider regarding medical concerns.
- Auditory & Sensory Safety: If you experience dizziness, hearing discomfort, sensory overload, or adverse reactions while using the procedural soundscape or haptics, discontinue use immediately. You may disable audio or haptic sensory channels independently within the app settings.
4. In-App Subscriptions & Purchases
SomaFocus offers both free core functionality and premium subscription tiers (“SomaFocus Pro”):
- Subscription Tiers: SomaFocus Pro is offered on an auto-renewing basis (e.g., Monthly and Yearly plans).
- Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected tier.
- Managing Subscriptions: You can manage or cancel your subscription at any time by going to your iOS Device Settings > [Your Apple ID] > Subscriptions.
- Refunds: All refund requests are governed by and must be submitted directly through Apple's App Store customer support policies.
5. Maintenance and Support
Conem Labs is solely responsible for providing maintenance and support for the Application. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to SomaFocus. Support requests can be directed to support@conemlabs.com.
6. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOMAFOCUS IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. CONEM LABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL CONEM LABS BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPLICATION.
8. Governing Law
This Agreement and the relationship between you and Conem Labs shall be governed by the laws of the jurisdiction in which Conem Labs operates, excluding its conflicts of law provisions.
